Terms of Service
Effective
1. Overview
These Terms of Service, called the Terms, govern your access to and use of PulseMail's website, waitlist, closed beta, email client, software, and related services, together called the Services.
By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
PulseMail is currently in closed beta. Features may change, break, be limited, or be discontinued as we test and improve the product.
2. Who we are
PulseMail is provided by CloudBridge Capital Limited, a company incorporated in Hong Kong S.A.R. Chinese registered name: 雲橋資本有限公司 (CloudBridge Capital Limited).
Registered address: Unit 2904-05, 29/F, Universal Trade Centre, 3 Arbuthnot Road, Central, Hong Kong S.A.R.
For legal questions, use our contact form (select Legal).
3. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Services unless we approve otherwise in writing. You may not use the Services if you are barred from doing so under applicable law.
4. Accounts
You may need an account to use some or all of the Services. You agree to provide accurate, current, and complete information; keep your account information updated; keep your login credentials secure; notify us promptly of unauthorized access or suspected compromise; and be responsible for activity under your account unless caused by our failure to use reasonable care.
We may refuse registration, suspend accounts, or reclaim usernames where reasonably necessary.
5. Waitlist and closed beta access
PulseMail may provide access through closed beta invitations, waitlists, or early-access waves. Joining the waitlist is a request for access, not a guarantee of it. We choose whom to invite and when, and we may ask you for a first name and short survey answers to help us decide. By joining the waitlist you accept these Terms and will receive the email needed to run the waitlist, such as verification codes and messages about your application and beta access, as described in the Privacy Policy. Product news is optional and separate; you can opt in or out at any time.
Beta access may be limited, revoked, changed, paused, or discontinued at any time. During beta, the Services may contain bugs, incomplete features, sync errors, data display issues, downtime, or performance problems.
You should not rely on the beta Services as your only copy of important email, attachments, files, business records, or legal documents. Keep your primary email account and backups available.
6. Existing email accounts and third-party services
PulseMail is designed to work with existing email accounts and third-party services. When you connect an account, you authorize PulseMail to access, process, sync, display, send, receive, organize, search, and manage information from that account as needed to provide the Services.
Your use of connected email providers and third-party services remains subject to their own terms and policies. PulseMail is not responsible for third-party services, account restrictions, provider outages, API changes, data loss caused by third-party systems, or changes made by providers.
You are responsible for ensuring that your use of PulseMail complies with the rules of any connected account or service.
7. Email sending, sync, and delivery
PulseMail may allow you to read, organize, draft, send, receive, archive, label, search, and manage email.
We do not guarantee that email will always sync instantly; email will always be delivered; drafts, labels, archives, folders, attachments, or message states will always display perfectly; third-party email providers will accept, deliver, or preserve messages; or search, summaries, categorization, and AI suggestions will always be complete or accurate.
You are responsible for reviewing important messages, recipients, attachments, and drafts before sending or relying on them.
8. Your content
Your content includes emails, drafts, attachments, files, text, images, feedback, and other material you submit, send, receive, store, or process through the Services.
You retain ownership of your content.
You grant PulseMail a limited, non-exclusive, worldwide licence to host, store, copy, process, transmit, display, format and technically modify your content only as necessary to provide the Services to you, keep them secure, support you when you ask, comply with law and enforce these Terms.
This licence does not allow us to sell your email content, use it for advertising, or use it to train or improve PulseMail or any model. We may use aggregated, de-identified measurements of how the Services perform (for example error rates) to improve them, and we may use your content for a specific improvement only if you separately agree to it.
9. Feedback
If you provide feedback, suggestions, ideas, or comments about PulseMail, you allow us to use them without restriction or compensation. This helps us improve the product.
10. AI-assisted features
PulseMail may provide AI-assisted features, such as summaries, drafting support, rewriting, search assistance, organization, and suggested next steps.
AI output may be incomplete, inaccurate, outdated, or inappropriate. You are responsible for reviewing AI-generated or AI-assisted content before using, sending, or relying on it.
You must not use AI-assisted features to violate laws or regulations; infringe intellectual property, privacy, or confidentiality rights; generate spam, deception, harassment, malware, or harmful content; or make legal, financial, medical, hiring, credit, housing, or other high-impact decisions without appropriate human review.
PulseMail may limit, modify, suspend, or disable AI features at any time.
11. Acceptable use
You agree not to use the Services to:
- violate any law, regulation, or third-party right;
- send spam, bulk unsolicited email, phishing, scams, or deceptive messages;
- harass, threaten, abuse, defame, or harm others;
- distribute malware, spyware, viruses, or harmful code;
- attempt unauthorized access to systems, accounts, data, or networks;
- interfere with or disrupt the Services;
- scrape, crawl, or extract data without permission;
- reverse engineer or attempt to derive source code except where allowed by law;
- circumvent security, usage limits, rate limits, or access controls;
- misrepresent your identity or affiliation;
- use the Services to build a competing product through unauthorized copying or benchmarking; or
- use the Services for high-risk activities where failure could lead to death, personal injury, severe financial loss, or serious damage.
We may investigate suspected violations and take action, including suspending or terminating access.
12. Prohibited email activity
You may not use PulseMail for abusive or unlawful cold email, purchased or scraped mailing lists, sending messages that violate anti-spam laws, impersonation, domain spoofing, fraudulent invoices, payment scams, credential harvesting, or attempts to evade provider sending limits, spam filters, or abuse controls.
We may apply rate limits, sending restrictions, verification requirements, domain checks, or other controls to protect the Services and other users.
13. Privacy
Our Privacy Policy explains how we collect, use, and share information. By using the Services, you acknowledge that your information will be handled as described there.
14. Security
We take reasonable measures to protect the Services, but no system is perfectly secure.
You are responsible for using strong authentication; protecting your devices; keeping credentials confidential; reviewing connected account permissions; and promptly reporting suspected security issues.
Report security concerns via our contact form (select Security). You can also choose General support if needed.
15. Intellectual property
PulseMail and its software, design, branding, trademarks, logos, graphics, interfaces, technology, and content are owned by PulseMail or its licensors.
These Terms do not give you ownership of PulseMail or any intellectual property rights in the Services.
You may not copy, modify, distribute, sell, lease, or create derivative works based on the Services except as expressly allowed by us or applicable law.
16. Third-party content and links
The Services may include links, integrations, or access to third-party websites, services, content, or tools. We are not responsible for third-party content, services, policies, or practices.
17. Suspension and termination
You may stop using the Services at any time.
We may suspend or terminate your access if you violate these Terms; your use creates risk or potential harm; we suspect abuse, fraud, or security issues; required by law or a third-party provider; or we discontinue or materially change the Services.
After termination, some provisions will continue to apply, including intellectual property, disclaimers, limitations of liability, indemnity, governing law, and dispute provisions.
18. Disclaimers
The Services are provided as is and as available.
To the maximum extent permitted by law, PulseMail disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, reliability, security, and error-free operation.
We do not guarantee that the Services will be uninterrupted, secure, accurate, complete, or free from errors, data loss, delays, or harmful components.
19. Limitation of liability
To the maximum extent permitted by law, PulseMail and its affiliates, officers, employees, contractors, agents, partners, suppliers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, lost goodwill, business interruption, or cost of substitute services.
To the maximum extent permitted by law, PulseMail's total liability for any claim relating to the Services will be limited to the greater of the amount you paid to PulseMail for the Services in the 3 months before the claim arose or USD 100.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or under mandatory consumer or data protection law. If you use the Services as a consumer, the limitations above apply only to the extent your local law allows.
20. Indemnity
If you use the Services in breach of these Terms or unlawfully and a third party brings a claim against PulseMail because of that, you agree, to the extent permitted by law, to compensate PulseMail for the loss, damage and reasonable costs that claim causes. This does not apply to claims caused by our own breach or negligence, and it does not apply to consumers where local law does not allow it.
21. Changes to the Services
We may modify, suspend, or discontinue any part of the Services at any time. During beta, changes may happen frequently.
22. Changes to these Terms
We may update these Terms from time to time. If a change is materially adverse to you, we will give you at least 30 days' notice by email or in the application before it takes effect, and you may end your use of the Services before then. Continued use after a change takes effect means you accept it; changes required by law or that only benefit you may take effect sooner.
23. Governing law and disputes
These Terms are governed by the laws of Hong Kong S.A.R., without regard to conflict of law rules.
If you are a consumer, you keep the protection of the mandatory consumer laws of the country where you live, and you may bring a claim in the courts of that country. Otherwise the courts of Hong Kong S.A.R. have exclusive jurisdiction over disputes arising from or relating to these Terms or the Services.
24. Assignment
PulseMail is provided by CloudBridge Capital Limited today. We may transfer these Terms, and the accounts and data under them, to a successor company that takes over the PulseMail business, provided the successor takes on the same obligations to you. We will tell you before such a transfer takes effect, and your rights under the Privacy Policy, including any consent you have given, carry over unchanged or are asked for again. You may not transfer your account or these Terms to anyone else.
